The new challenge in the fight against counterfeiting of products and associated digital information is to incorporate both physical and digital protection to protect brand and image. The protection of the product information QR code creates a double barrier because a verified QR code on the packaging guarantees the product and brand information.

NEW PROVISIONS TO STRENGTHEN THE FIGHT AGAINST COUNTERFEITING AND ITALIAN SOUNDING
The provisions provide for a reorganisation of the judicial offices with the aim of promoting the specialisation of magistrates in the fight against counterfeiting. In addition, the provisions on confiscation and administrative penalties (for the worse) for the purchase and importation of counterfeit goods are amended.

NEW PACKAGING LABELLING
How to respond to the obligation: Having examined the Regulation and identified the information required for the environmental labelling of packaging, it is appropriate to consider that, as an alternative to physically affixing such information on the packaging, it is possible to make it available through digital channels of choice (e.g. app, QR code, websites) in order to simplify the production, operational and economic processes of companies that place such packaging in more than one EU country, thus ensuring compliance with the principles of free movement of goods guaranteed by the Treaty on the Functioning of the European Union. Where digital channels are used, instructions for the collection of the mandatory information described above must be made easily known and accessible to the user.
